Collaborative Law and Family Mediation

Collaborative law is an approach used to resolve issues when couples are divorcing in an open and non-confrontational way, avoiding the need to go to court.

During the process each side has their own fully accredited collaborative lawyer to advise and support them, and unlike mediation the couples and their lawyers come together to have face-to-face meetings. The aim of this approach is to get couples to work together to resolve any issues in a mutually amicable way, in an attempt to reduce the impact that the divorce has on children as well as proving more time and cost-effective.

Collaborative law is regarded as one of the best approaches for preventing couples who are divorcing or separating from going to court. You and your former partner will be expected to fully disclose information openly, but it allows you to stay in control of the situation rather than the court managing the process. Once an agreement has been reached between both sides then it is signed and sent to the Court to be approved by a judge to form a court order which is legally binding.

What is Family Mediation?

Family mediation, like collaborative law, provides an alternative to going to court, but negotiations are led by a mediator who is a neutral third party. There are different types of mediation available depending on whether you wish to see your ex-partner during negotiations or not, or if you require more specialist advice.

As with collaborative law, mediation can be less stressful and confrontational than court proceedings and have less of an impact on your children. Compared to the court process, where the judge will make decisions on your behalf, your mediator will help you in finding solutions that work in the interests of both parties although the mediator cannot provide you with legal advice.

If you are applying for a financial remedy or a matter in relation to children, mediation is now a compulsory step if a party issue court proceedings and you will be expected to have at least tried this approach before you apply to the court to hear a case.
