Dental Negligence Compensation
Dental Negligence claims are often caused by misdiagnosis or negligent treatment when a Dentist carries out a common procedure. Most people aren’t fond of visiting the dentist and this can be made much worse if you have a bad experience or suffer injury as a result of negligent treatment.

Whether your treatment was provided by an NHS or Private Dentist, you may have a claim for dental negligence and your claim will be against the individual Dentist who provided the treatment.
What do I need to prove to be successful in a Dental Negligence claim?
To be successful in a dental negligence claim you must prove two things –
- That your treatment fell below an acceptable standard,
- That you have suffered injury/loss as a consequence of that unacceptable level of care.
Common Dental problems
Dentists carry out many procedures daily and each of them presents a certain amount of risk. Dentists should discuss with you the potential risks of the proposed treatment before they complete the work often, they will provide you with a treatment plan in advance.
Some of the more common procedures or events which could bring about a dental negligence claim are:
- Misdiagnosis or failure to provide appropriate treatment
- Unnecessary extraction of a tooth (or removal of the wrong tooth) leading to infection, swelling or excessive bleeding.
- Mistakes during, filings, crown or bridge work
- Root canal procedures
- Cosmetic dental procedures (including but not limited to composite bonding, teeth whitening, poorly fitted veneers, inlays/onlays, contouring and reshaping)
- Dental implants
- Poor record keeping or failure to prescribe the appropriate medication.
- Failure to treat gum disease correctly, leading to tooth loss or other medical problems.

- Failure to refer to a specialist
