How Much Compensation Can I Claim After a Road Traffic Accident?

Road traffic accident claims can be complex, especially if they result in serious injury. As such, it is difficult to so say how much your claim might be worth.

The amount of compensation you can claim for a road traffic accident depends on:

  1. The type and severity of your injury
  2. How that injury has and will affect your life

How Compensation Helps

The purpose of compensation is to put you back in the same position you were before your injury.

The total sum of compensation you will receive is called the ‘Quantum of Damages’. That said, there are two parts to a compensation claim.

General Damages

This is the amount of compensation you will be awarded for:

  • The type of injuries you have suffered
  • The severity of your injuries
  • The effects your injuries have on your physical abilities
  • The effects the whole experience has had on your mental health
  • Your future quality of life

Special Damages

General damages reimburse all your ‘out of pocket expenses’. These include:

  • Loss of earnings – This includes wages, tips, bonuses, overtime and pension contributions, both now and in the future.
  • Medical expenses – Including specialist medical care and treatment, physiotherapy and rehabilitation.
  • Travel costs – Like specialist transport and taxis.
  • Mobility aids and assistive technologies – Like wheelchairs, walking frames etc.
  • Modifications to your home and/or vehicles – Installing stair lifts, car hoists, widening doorways, for example.

General damages also take into account the cost of lifelong care and support.

How Long Have I Got to Claim Compensation After a Road Traffic Accident?

In most cases, road traffic accident claims are subject to a three-year time limit.

That said, there are some exceptions to this:

  • Children – For children involved in an RTA, you have until their 18th birthday to claim. After that, they have three years to claim for themselves.
  • Lack of mental capacity – There are no time limits for claiming on behalf of a loved one who lacks the mental capacity to claim themselves.
  • Road traffic accidents that happened abroad – Time limits might be shorter.

Time limits aside, you should seek legal advice as soon as possible after a road traffic accident.

The sooner you do this, the better you will remember the events that led up to your accident. It will also be easier for us to gather evidence and witness statements for a successful claim.

How Long Do Road Traffic Accident Claims Take to Settle?

The time it takes to reach a settlement for a claim can vary in a huge way. It depends on the type and severity of your injury.

Claims for serious injuries like spinal and brain injuries can take years to settle. We need to take this time to understand:

  1. How these injuries will affect the rest of your life, and

Will I Need a Medical Examination?

To make a road traffic accident claim, we need to gather evidence of your injuries and their impact on you and your life.

To do this, you will need a medical assessment with an independent medical expert. They will produce a report that we can then use in evidence.

Depending on the type and severity of your injuries, you might need more than one assessment.

Will I Have to Go to Court?

When making a claim for a road traffic accident, we need to establish who is at fault. Then we work hard to get an admission of liability.

If we can get the other side to accept fault, we can settle you claim without court proceedings. This is how most cases go.

The only time a claim would go to court is if:

  1. The other side refuses to accept liability, or
  2. They dispute the amount of compensation to be paid

My Insurance Company Has Recommended a Law Firm, Do I Have to Use Them?

A lot of insurance companies have solicitors and law firms they prefer to work with. However, they are not allowed to insist you use them so you are free to make up your own mind about who represents you.

I Was Partly to Blame For My Accident, Can I Still Claim?

If you think you were partly to blame, it is still worth contacting us. You might still be able to claim.

That said, your level of blame will reflect the amount of compensation you will receive.

For example, if it is deemed that you are 50% liable, then 50% will be deducted from your claim. So, if you claim is worth £10,000, you will get 50% of that, so £5,000.

The Care Quality Commission (“CQC”) have released the results into a survey they conducted relating to the experience of women and other pregnant people who had a live birth in early 2023. The survey had national reach and responses were received from over 25,000, a response rate of 41%.

The Animals (Penalty Notices) Act 2022 is a new piece of secondary legislation which came into force from 1 January 2024. The act was passed following an 8 week consultation with various different parties with interest in animal welfare such as veterinarians, the National Farmers Union, the British Veterinary Association and the RSPCA.
